‘A Woman of Strange, Unfathomable Presence’: Ida Platt’s Lived Experience of Race, Gender, and Law, 1863-1939

In 1894, Ida Platt became the first African-American woman lawyer in Illinois. She was one of only five black women lawyers in the country and the only one able to maintain a law practice. Throughout her thirty-three year career, Platt served as head of her household, providing for her mother and sisters, without marrying or having children. She accomplished these feats by employing a fluid racial identity, passing as white in her professional life, and by avoiding the dominant gender roles that excluded women from the masculine legal profession. In 1927, at the age of sixty-four, Ida Platt retired, married Walter Burke, a white man, and moved to England. Twelve years later, Ida Burke died. As is the practice in England, there was no race designation on her death certificate.

Platt’s choice to employ a fluid racial identity allowed her to pursue her career as a lawyer amidst a racist and sexist society that particularly discriminated against black women. She entered the law when Jim Crow was taking root, race lines were hardening, and elite, white, male lawyers were intensifying their opposition to women’s rise within the profession. Platt’s life and career offer insights into how law and the legal profession responded to the complexities of race and tender a new story of the lived experience of race as it intersects with gender. It suggests that Platt’s pragmatic strategy of changing her racial identity both contested and shaped the ways in which race, gender, and identity were constructed and represented in American society, as it exposed both the rigidity and permeability of these constructions.

Minnie Bradley was arrested on the evening of December 11, 1902, and charged with “larceny from the person” or pickpocketing. Someone from the Midway Saloon, a well-known dance hall and whorehouse owned by several notorious Omaha crime bosses, offered to pay her $25 bond. Before she was released, W. H. Breiter showed up at the police station and identified Minnie as the person who had robbed him earlier that evening. Minnie offered Breiter $5 to drop the charge, but he refused, so she spent the night in jail…

…Minnie returned to Omaha in 1904 and made two more appearances in police court before Judge Berka. The first, in March 1904, was as witness against a man named William Warwick, who was accused of assaulting her. The two had gotten into a heated argument when he bragged to her that, due to his light complexion, he often passed as a white man during his travels out west. He also mentioned that he had been in the company of two white women the previous evening. Minnie said William should show more respect for his race and reminded him that his mother was a black woman. His response was to punch her. Judge Berka sentenced him to 30 days in jail…

Alison Fornés, an education consultant based in Salem, Massachusetts, wrote to us wanting to speak with her mother, Julia, as part our “Uncomfortable Truths” series.

Talking to your mom about identity may not seem like a conversation most people would classify as “uncomfortable,” but Julia largely kept the story of her upbringing from her daughter. In 1956, at just six years old, Julia was sent from Puerto Rico to an orphanage in Connecticut. Because of racial tensions in the area in 1956, Julia was discouraged from carrying on her traditions from back home in order to be viewed as a more desirable adoptee for a family. She spent much of her life trying to pass as anything but Puerto Rican.

As Alison got older, she started to wonder why she didn’t know more about her mother’s childhood traditions back in the Caribbean. So she sat down to ask Julia about why she felt compelled to hide her Puerto Rican identity, and how she eventually came to embrace it.

Racial passing–presenting oneself as a race other than one’s own–is often viewed negatively (Dawkins, 2012), but the reason is unclear. Thus far, our lab has shown that passing as a member of a lower status racial group (i.e., as Black) is more morally condemned than the reverse (i.e., passing as White). We have also demonstrated that people who endorse Colorblind ideology judge racial passing more harshly, perhaps because it threatens their core beliefs. In our next step, we will measure stress and cognitive depletion to examine why people find racial passing to be morally condemnable under these circumstances.

It is 1996 in Brooklyn. The crime rate is on the decline, artists are fleeing Manhattan and its staggering rents for neighborhoods such as DUMBO, Williamsburg, and Greenpoint, immigrants are flocking to the borough, and you could still buy a brownstone for under $500,000. This is also the year of the Fugees’s iconic album The Score, Lil Kim’s Hardcore, Foxy Brown’s Ill Na Na, and Jay-Z’s Reasonable Doubt. The era was one of creativity, movement, and rapid innovation, making it fertile ground for the racial dynamics explored in Danzy Senna’s highly anticipated third novel, New People. In a decade when the country had witnessed the Rodney King beating, the Los Angeles Riots, and the O.J. Simpson trial, racial tension were at an all-time high. This is not the time to try and escape one’s race. But there are Black Americans whose trauma from decades of racism leads them to cultivate themselves into a world of the light-skinned elite, and a world where they hope they will be safer, more compatible with the American Dream.

This is the world in which we meet Maria Pierce and Khalil Mirsky, two light-skinned, mixed race black people who want it all and are on track to get it: a Brooklyn brownstone, a wedding at a lighthouse in Martha’s Vineyard with nouveau soul food, a dog named Thurgood, and two children “with skin the color of burnished leather” and “hair the color of spun gold” named Indigo and Cheo. Maria and Khalil met at Stanford, where they fell in love over conversations about interracial dating and misogyny in hip-hop, Giovanni’s Room and Cosby episodes, chicken and waffles. Now, Khalil, a part-time technology consultant, is about to take advantage of the dot-com boom by creating an online community of black “modern tribalism” with his friend, while Maria spends her days finishing up her dissertation on the Jonestown Massacre. Rogers Brubaker is a sociology professor at the University of California, Los Angeles, and the author, most recently, of “Trans: Gender and Race in an Age of Unsettled Identities.”

The world of academic philosophy is ordinarily a rather esoteric one. But Rebecca Tuvel’s article “In Defense of Transracialism,” published in the feminist philosophy journal Hypatia this spring, has generated a broad public discussion.

Dr. Tuvel was prompted to write her article by the controversy that erupted when Rachel Dolezal, the former local N.A.A.C.P. official who had long presented herself as black, was revealed to have grown up white. The Dolezal story broke just 10 days after Caitlyn Jenner’s Vanity Fair debut, and the two discussions merged. If Ms. Jenner could identify as a woman, could Ms. Dolezal identify as black? If transgender was a legitimate social identity, might transracial be as well? Dr. Tuvel’s article subjected these public debates to philosophical scrutiny.

The idea of transracialism had been rejected out of hand by the cultural left. Some worried — as many cultural conservatives indeed hoped — that this seemingly absurd idea might undermine the legitimacy of transgender claims. Others argued that if self-identification were to replace ancestry or phenotype as the touchstone of racial identity, this would encourage “racial fraud” and cultural appropriation. Because race has always been first and foremost an externally imposed classification, it is understandable that the idea of people declaring themselves transracial struck many as offensively dismissive of the social realities of race…

In 1948, journalist Ray Sprigle traded his whiteness to live as a black man for four weeks. A little over a decade later, John Howard Griffin famously “became” black as well, traveling the American South in search of a certain kind of racial understanding. Contemporary history is littered with the surprisingly complex stories of white people passing as black, and here Alisha Gaines constructs a unique genealogy of “empathetic racial impersonation”–white liberals walking in the fantasy of black skin under the alibi of cross-racial empathy. At the end of their experiments in “blackness,” Gaines argues, these debatably well-meaning white impersonators arrived at little more than false consciousness.

Complicating the histories of black-to-white passing and blackface minstrelsy, Gaines uses an interdisciplinary approach rooted in literary studies, race theory, and cultural studies to reveal these sometimes maddening, and often absurd, experiments of racial impersonation. By examining this history of modern racial impersonation, Gaines shows that there was, and still is, a faulty cultural logic that places enormous faith in the idea that empathy is all that white Americans need to make a significant difference in how to racially navigate our society.
